New Zealand employers are required to have written employment agreements for all of their employees, no matter when they started or whether they are full-time, part-time or casual.
Most businesses are aware of this requirement under the Employment Relations Act 2000, but some employers still take the risk of not ensuring they have employment agreements in writing.
From 6 May 2019, employers who don't have employment agreements in writing for each of their employees are liable for a $1,000 fine per employee. Even if the employee hasn’t signed an agreement, the employer must keep a copy of an 'intended agreement'.
This is not an idle threat. Scan the headlines and you'll see that the Ministry of Business Innovation and Employment (MBIE) regularly fines businesses for failing to produce written employment agreements when requested.
It's not that hard to create a legally-compliant employment agreement, and there is absolutely no reason why any employer, of any size, anywhere in New Zealand should not have all their employees on signed agreements. It is such a simple process and technology has made it much easier.
